JEFFERSON COUNTY — Charges were dismissed Friday against 27-year-old Mt. Vernon man charged in connection with a July shooting incident that sent one person to the hospital.

Calvin Webster turned himself in to Jefferson County authorities in September, after they had been searching for him for nearly two months following a July shooting incident that resulted from a dispute in the 1000 block of South 25th. One person was sent to the hospital with a gunshot wound from a shot that Webster was alleged to have fired in that incident.

Webster was subsequently charged with Class X felony aggravated battery through the discharge of a firearm and Class 1 felony aggravated discharge of a firearm into an occupied building or structure. Both charges were dismissed Friday.

According to online court records, Webster was charged in Jefferson County Court in 2014 with Class 1 felony aggravated discharge of a firearm at an occupied vehicle and Class 3 felony possession of a firearm by a convicted felon. Those charges were dismissed against him in March.

In July of this year, Webster filed a lawsuit in federal court against the City of Mt. Vernon and the Mt. Vernon Police Department, claiming his Fourteenth Amendment rights had been violated. The lawsuit claims Webster was arrested on or about October 12, 2013, for felony possession of a firearm and aggravated discharge of a firearm.

The suit further claims that Webster posted bond and was released on those charges, but was arrested again on the same charges and held for six weeks without legal justification. He says it was those charges against him that were dismissed without explanation on March 3, 2015.

Webster is seeking a monetary award in excess of $50,000, and compensatory damages in excess of $50,000 from the City and the Police Department.
