Iuka man sentenced to IDOC after pleading guilty to domestic battery

MARION COUNTY — A 28-year-old Iuka man was sentenced Thursday in Marion County Court to 6-years in the Illinois Department of Corrections after he pleaded guilty to felony domestic battery.

Ryan McCarty was originally charged with Class X felony home invasion causing injury, Class 2 felony aggravated domestic battery using strangling, and Class 3 felony aggravated battery of a pregnant or handicapped person. He has remained in the Marion County Jail since his arrest, with bail set at $100,000.

McCarty pleaded guilty to the Class 2 charge in exchange for the Class X, the more serious of the three charges, and the Class 3 charge, the least serious of the three charges, being dismissed.

In addition to the 6-year prison sentence, McCarty was sentenced to 4-years supervised release once he completes his prison term, and was ordered to pay fines, fees and court costs.

McCarty was arrested in April 2015, after he entered his ex-girlfriend’s Salem home, and after an argument between the two he threw her onto the couch, began choking her, and striking her knowing she was pregnant.

In 2013 McCarty was sentenced to two-years in the Illinois Department of Corrections on a 2012 conviction for felony aggravated battery causing great bodily harm. A felony charge of home invasion causing injury was dismissed in that case also per a plea agreement.
