JEFFERSON COUNTY — Both the prosecution and defense have rested in the trial of a 25-year-old man charged with the 2011 murder of a Mt. Vernon cab driver with jurors expected to be handed the case for deliberation following closing arguments Tuesday.

Monday was the third day of testimony in the case against Mark Taylor Jr. The prosecution delivered their opening statements on Thursday and offered witness testimony and evidence they say proves Taylor is guilty of first-degree murder in the botched robbery and shooting death of 75-year-old Charles Ellis.

The prosecution rest its case around 10:40 Monday and following a short recess the defense was handed the handed the case. Taylor was questioned regarding his right to testify and he waived his right to testify.

The defense rest its case just after 11 a.m. and the jury was recessed for the day while the court prepared jury instruction for Tuesday.

The trial is scheduled to resume at 9 a.m. Tuesday with closing arguments to be delivered before the case is handed to the jury for deliberation.
