FAYETTE COUNTY — Sentencing for a 24-year-old Vandalia woman who pleaded guilty in October to aggravated battery of her infant son has been scheduled for January, after being delayed last month.

Aubree Hammer was set to be sentenced in November in Fayette County Court; however, due to the length of the pre-sentence investigation report, the sentencing hearing was delayed to allow the prosecution and defense time to review the more than 200 page pre-sentencing report. It was agreed in court Tuesday to set the sentencing hearing for January 16.

Hammer entered an open guilty plea to one count Class X felony aggravated battery to a child under the age of 13 causing great bodily harm or permanent disability. A Class X felony is punishable by between 6 and 30 years in prison.

Court records say Hammer held her infant son head high and threw him to a wooden floor causing the baby brain damage.

Defense counsel had earlier filed a motion for a fitness evaluation on Hammer and the fitness exam conducted by Dr. Daniel Cuneo found Hammer mentally fit.
