FAYETTE COUNTY — Sentencing for a 25-year-old Vandalia woman who pleaded guilty last year to causing permanent disability of her infant son scheduled in Fayette County Court Monday for March 14.

Aubree Hammer was set to be sentenced in November in Fayette County Court; however, due to the length of the pre-sentence investigation report, and scheduling of experts, the sentencing hearing has repeatedly been delayed.

Hammer entered an open guilty plea in October 2017, to one count Class X felony aggravated battery to a child under the age of 13 causing great bodily harm or permanent disability.

Court records say that on February 18, 2016, Hammer held her infant son head high and threw him to a wooden floor causing the baby permanent brain damage.

Unlike a usual guilty plea, an open plea of guilty has no agreed upon sentence. A Class X felony is punishable by between 6 and 30 years in prison without aggravating factors.
