Garrett McElveen was indicted on 11 counts Class X felony predatory criminal sexual assault of a child, and on one count sexual exploitation of a child. McElveen was initially arrested in December, but formal charges were delayed while a mental fitness examination was conducted.

While a mental evaluation submitted to the court Wednesday did find McElveen suffers from some psychiatric problems, it also found he is mentally fit to stand trial on the charges he committed multiple sexual acts with a female victim under the age of 13.

Speedy trial in the case has been waived and McElveen remains in the Jefferson County Jail with bail set at $300,000. He has remained in custody since his December arrest.

He is next scheduled in court for an April 27 pre-trial conference.
